my battery is not charging, and the voltage reg is getting warmer than it should (you cant hold your hand on it for more than 3-4 seconds). i have inspected all wiring and nothing is rubbed through anywhere.... would it be safe to say my stator is bad?

It could also be the regulator.
Or even but doubtfully a bad battery
First check for dirty connections.
unplug regulator and test stator output this is usually AC
You can also do a resistance check on the stator windings.
I would believe if the regulator is getting hot then the stator is putting out.
I would not run the bike this way as a shorted regulator will fry your stator.
I am only speaking from my knowlage of motorcycles and quads in general.
Im sure there is some stickies around here somewhere.

It would be much more likely that the rec/reg is bad - perhaps a shorted diode in the rectifier.
